Join the EC Defense Network for their 2019 Spring Meeting! This year's meeting will begin with a Thursday evening opening reception, a perfect opportunity to network with your fellow attendees.  Then, get ready for an interactive program Friday, with three outstanding sessions, ending with our luncheon speaker. See the detailed schedule below.

Once the education is complete, attendees will have the opportunity to enjoy the sites and sounds of New York City.  A block of tickets for Tootsie has been reserved for our attendees for the 8:00pm show on Friday, April 26th.  Be sure to tell us you wish to attend on the RSVP form.

Personal Liability for Insurance Adjusters in Bad Faith Claims: What's Behind this Trend and Will it Continue?

There is no question that efforts to name insurance adjusters personally in bad faith lawsuits have increased in the past few years. While the use of such tactics to leverage early settlements is not necessarily a new development, the increase in these claims is  substantial. The predominant factor driving this increase is recent court decisions validating such claims. This presentation will look at recent case law on this issue, and analyze whether the potential that insurance adjusters could be held personally liable for their own bad faith conduct is an emerging trend or a short-term fad.

Insurance claims and underwriting professionals are called upon to testify in civil legal proceedings on a regular basis, typically in litigation against their companies.  Like many other individuals, insurance professionals possess tremendous technical and professional expertise but often lack the skill or experience necessary to manage an attorney's examination and communicate their truth in a manner that is clear and incapable of mischaracterization.  This presentation by Todd Betanzos, a trial consultant whose expertise is witness communication training, will provide insurance professionals and their counsel with a new perspective on depositions in coverage and extra-contractual litigation and the importance of proper witness preparation in positioning these cases for favorable resolution.  Todd's presentation will include a primer on the unique communication rules applicable to legal proceedings, the rights and responsibilities of a witness under oath, and the skills that will help them to make truthful, accurate and powerful testimony.
