An insurer rejects a policy limit demand pre-suit. The insured driver is then sued, fails to give the insurer notice, and goes into default. An excess judgment is entered on an uncontested bench trial for $2.9 million. Then the bad faith judgment is affirmed by the Supreme Court of Georgia. How? And why? And what can insurance companies learn from this decision to avoid the same outcome?

Bad Faith in COVID-19 Property Coverage Litigation

While courts across the country continue to weigh in on whether claimed losses arising from government-induced shutdown orders during the COVID-19 pandemic are covered under first-party property insurance policies, the issue of bad faith liability in this litigation has not received the same amount of attention. This presentation will discuss the potential for insurers to face bad faith liability for these claims, how courts have dealt with bad faith claims in this litigation, and the potential theories of bad faith liability arising out of these cases.
